Question : Problem: Sad face problem on IPod Photo

I have IPod Photo 30GB it was working fine but after a while its jamming for 2 or 3 times then it stopped working completely and now its giving me the Apple logo the image of the iPod itself with sad face and examination mark and writing down http://www.apple.com/support/ipod so I tried to connect it to a pc or Mac it doesnt appear then its give me a logo of battery with one black strip on the battery

Sad Face is not good. Is it still under warranty? Everyone I've ever known that has had a sad face had to get it replaced.
